Win one for the gay gals, lose one for the bigots

Yesterday, VOSD stringer Randy Dotinga chided me on Facebook for the headline I slapped on a blog post about a gay federal public defender who won compensation for denial of spousal benefits.  Dotinga pointed out that although I called it “Win one for the gay guys,” it was a win for lesbians too…

Well! It’s as if Dotinga had a premonition. Today Ninth Circuit Court of Appeals Chief Judge Alex Kozinski issued a ruling granting a female staff attorney at the Ninth Circuit headquarters coverage for her same-sex spouse.

Here’s the opinion.

Meanwhile, proponents of Prop 8 took a hit. “Campaign for California Families” had sought to be listed as a defendant/intervenor in a federal suit challenging the Constitutionality of Prop 8. The Campaign argued that the “Official Proponents of Prop 8” and ProtectMarriage.com–two of the parties to the suit–would not “adequately represent all the Campaign’s interests.”

In other words, the Campaign wanted a piece and claimed that the other two anti-Prop 8 organizations weren’t on  the same page.

The Ninth Circuit Court of Appeals called bullshit and denied the appeal. Judge M. Margaret McKeown wrote: “Any differences are rooted in style and degree, not the ultimate bottom line. Divergence of tactics and litigation strategy is not tantamount to divergence over the ultimate objective of the suit.”

    Prop 8 will probably join the other anti-gay marriage propositions in the dust bin within five years, whereupon yet another proposition will be put forward to ban gay marriage. It would be best if the California legislature would legalize gay marriage, if only to end the legal fees, the time wasted in court, and the waste of effort (petitioning, fundraising, putting up advertising) the religious Right puts into banning homosexual unions.
